The Board of Supervisors of Carroll County, Iowa met in regular adjourned session in the Boardroom of the Courthouse, in Carroll, Iowa, the County seat of said County on Monday, April 24, 2017 at 9:00 a.m. Daylight Saving Time pursuant to law, the rules of said Board and to the adjournment with all members present: Neil Bock, District 1; Dean Schettler, District 2; Eugene Meiners, District 3; Marty Danzer, District 4; and Richard Ruggles, District 5.

Motion by Bock, second by Danzer to approve the agenda as presented. On roll call, all voted aye. Motion by Schettler, second by Ruggles to approve the minutes of the April 17, 2017 meeting with a correction. On roll call, all voted aye.

County Engineer Dave Paulson and E911 Coordinator Jason Hoffman met with the Board to discuss County street signs. Paulson presented a quote from Iowa Prison Industries for replacing signs in Carroll County. The quote has two options; Option 1 includes approximately 2,555 signs with 6”/3” font on 10” blanks for $76,515.52. This option would be the same size as the current signs in use in the County. Option 2 includes approximately 600 signs with 8”/4” font on 10” blanks and 1,955 signs with 6”/3” font on 10” blanks for $80,506.42. This option would place larger signs at paved intersections and leave the current sized signs on the gravel intersections. Paulson explained the Roads FY18 budget has $100,000 for sign replacement. Hoffman explained that E-911 would like to have the County purchase and install the new signs and they will reimburse the Secondary Road Fund over the next 4 years. Following discussion, motion by Danzer, second by Schettler to approve Option 2 for $80,506.42. On roll call, all voted aye. Secondary Roads will purchase and install signs in FY18. The E-911 Fund will reimburse the Secondary Road Fund beginning in FY18 with balance paid by FY21. On roll call, all voted aye.

Ambulance Director Pat Gray reviewed January 1, 2016 – June 30, 2016 billing data. The data included the number of various types of calls, revenue received, and rates for various types of calls. Gray explained the process his office uses to complete billing and submittal to Insurance Companies and the appeals process. Following discussion, the Board thanked Gray for his explanation and clarification of his Department’s billing process. No formal action taken.

Motion by Ruggles, second by Danzer to approve a plat of survey for Lot 3 SW1/4 Section 28-84-36. On roll call, all voted aye.

Motion by Bock, second by Schettler to approve a Class B Native Wine Permit with Living Quarters, Outdoor Service and Sunday Sales for Barn Owl Gift & Greenhouse. On roll call, all voted aye.

Motion by Danzer, second by Ruggles to approve a fireworks display permit application for Paul Schumacher for July 29th. On roll call, all voted aye

Motion by Schettler, second by Ruggles to approve payment of the payables as presented. On roll call, all voted aye.

Meiners updated the Board on the upcoming sale of the County Home. County Attorney John Werden has prepared a resolution authorizing the Chair of the Board of Supervisors to complete the sale and convey the County Home property. Motion by Ruggles, second by Danzer to approve Resolution 2017-005, To Complete the Sale and Convey the County Home Property. On roll call, Meiners, aye; Ruggles, aye; Schettler, aye; Bock, aye; and Danzer, aye. Motion carried unanimously.

RESOLUTION 2017-005

On the 17th day of January, 2017, Notice of Public Hearing was published in a legal newspaper. On the 23rd day of January, 2017, after Public Hearing, the Board of Supervisors approved the sale of certain lands of Carroll County. The survey has been recorded as Inst. Number 2017-1162.

Therefore, be it resolved that the Chair of the Board of Supervisors is hereby authorized to complete the sale and convey said property as follows:

Lot One (1) of the Southwest Fractional Quarter of the Northwest Quarter (SWfrl1/4 NW1/4) of Section Seven (7), Township Eighty-four (84) North, Range Thirty-four (34) West, of the 5th P.M., Carroll County, Iowa;

AND

Lot One of the Northwest Fractional Quarter of the Southwest Quarter (NWFrl1/4 SW1/4) of Section Seven (7), Township Eighty-four (84) North, Range Thirty-four (34) West, of the 5th P.M., Carroll County, Iowa.

EXCEPT Carroll County retains ownership of a structure located thereon to wit: a communication tower, more particularly described in the drawing attached to this resolution, including the guy wires, guy anchors, cables, and other appurtenant equipment.

Carroll County reserves an easement in perpetuity for ingress, egress, and placement, maintenance and use of utilities as well as the right to place additional and replacement equipment including a tower and structure to house equipment used in connection therewith.

Grantor does hereby reserve to Carroll County, its successors and assigns, a perpetual, easement for the maintenance of a communication tower located on the above-described real estate and may replace, construct and substitute another in the future.

Grantor shall have the right to remove from the easement area, any obstructions, including but not limited to: trees, plants, undergrowth, buildings, fences, and structures that interfere with the proper operation and maintenance of said tower and equipment.

Grantee agrees that it will not construct or place any permanent or temporary buildings, structures, fences, trees, plants, or other objects on the easement area or make any changes in ground elevation without written permission from Grantor indicating that said construction or ground elevation is approved, or otherwise interfere with the Grantor’s rights to operate and maintain the tower.

Grantee shall have no right of use of the communication tower.

FURTHER EXCEPTING and reserving to Grantor in perpetuity the right and privilege to use and utilize the water, sewer and all other utility lines serving the conveyed property by extension and additional cables and pipes to use the same for other property as well as Grantor’s real estate by extension, modification and use of the existing lines in the conveyed property in and across, through and under the conveyed property to serve, including, but not limited to, Carroll County property in the Southwest Fractional Quarter of the Northwest Quarter (SWFrl1/4 NW1/4) of Section Seven (7), Township Eighty-four (84) North, Range Thirty-four (34) West, of the 5th P.M., Carroll County, Iowa;
